Marketplace Conduct & Acceptable Use Policy

Effective Date: October 8, 2025

Contact: team@mocagem.com

Mocagem does not host on-site reviews, comments, forums, or messaging. Listings are created and published by Mocagem using information supplied by vendors. This policy sets rules for platform conduct (users and vendors), how listings are created and kept accurate, and how off-platform reviews (e.g., Google) are handled.

1) Scope

  • On-platform: Users browse and pay for offers. Mocagem creates listings from vendor-provided details.

  • Off-platform: Reviews and public feedback occur on Google/other third-party sites; Mocagem doesn't control or moderate those platforms.

2) Prohibited Activities (All Users & Vendors)

Do not:

  • Break the law (consumer protection, advertising, tax, health/safety, privacy/PIPEDA, CASL, etc.).

  • Mislead or defraud (false identity, pricing, availability, fulfillment, or outcomes; fake/simulated transactions).

  • Evade fees or abuse payments (steer an in-progress Mocagem order off-platform; side payments to avoid fees; unauthorized payment methods; chargeback abuse; splitting/structuring to game fees or incentives; interfering with authorized holds/adjustments).

  • Manipulate orders/availability (bot buying, hoarding, artificial throttling, reselling/transfer against listing terms).

  • Harass, spam, or solicit (abuse, threats, hate, doxxing; unsolicited promos).

  • Attack the platform (hacking, scraping at scale, bypassing rate limits, malware, DDoS, unauthorized bots/API abuse).

  • Infringe rights or post unsafe/illegal content (IP, privacy, publicity rights violations; illegal/unsafe offerings).

  • Misuse personal data (collect/use/share outside our Terms/Privacy Policy or applicable law).

3) How Listings Are Created (Mocagem-Managed)

  • Vendor input → listing: Vendors supply title, description, price, taxes/fees, availability, booking/pickup/delivery rules, restrictions, images/logo.

  • Editorial control: Mocagem formats/edits for clarity, compliance, and quality; may reorder, pause, or decline content.

  • Vendor review: Vendors may review key terms (price, availability, restrictions) before go-live and must respond promptly to avoid delays.

  • Change duty: Vendors must notify Mocagem immediately of changes that affect accuracy or fulfillment.

4) Vendor Responsibilities (Pay-Per-Transaction)

Vendors must:

  • Honor the order as listed—no undisclosed surcharges or term changes to offset platform fees.

  • Be accurate & current—pricing, taxes/fees, availability, blackout dates, service areas, booking/fulfillment timelines.

  • Customer service—handle service issues post-purchase and comply with consumer laws.

  • Taxes & receipts—calculate, collect, remit taxes; issue receipts as required.

  • IP & license—own/hold rights to submitted assets and grant Mocagem a non-exclusive, royalty-free license to use them for listings and platform promotion.

  • Reviews—follow Google's review rules; no fake/paid reviews, gating, intimidation, or retaliation; don't disclose personal data in responses.

5) User Expectations

Users should:

  • Review listing details (price, availability, booking/pickup/delivery rules, restrictions) before purchase.

  • Use accurate account and authorized payment methods.

  • Contact the vendor directly for post-purchase service issues (refund/cancellations are handled by vendors per their policies).

6) Off-Platform Reviews (Google, etc.)

  • Users: Share honest, first-hand experiences on Google; for order issues, contact the vendor first.

  • Vendors: Handle review disputes via Google's tools; keep responses professional and privacy-safe.

7) Enforcement & Remedies

Mocagem may, at its discretion:

  • Warn, edit, pause, or remove listings/content.

  • Limit features or purchasing/fulfillment access.

  • Suspend or terminate user/vendor accounts.

  • Withhold, reverse, or adjust fees, credits, incentives, or payouts tied to violations, fraud, or chargebacks.

  • Report suspected illegal activity to authorities and pursue recovery of losses/costs.

8) Reporting Concerns

Email team@mocagem.com with vendor name, order ID (if any), URLs/screenshots, timestamps, and a brief description. We review reports and act where appropriate.

9) Changes

We may update this Policy; changes are effective when posted with the new effective date. Continued use of Mocagem constitutes acceptance.
