Welcome to Mocagem! By accessing or using our website, app, and services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. What Mocagem is

We're a marketplace. You buy products or services on Mocagem. We process your payment. The vendor fulfills what you bought.

2. Eligibility

You must be at least 18 years old to use our services. By using Mocagem, you represent and warrant that you meet this eligibility requirement.

3. Account Registration

You may need to create an account to claim deals. You agree to provide accurate, current, and complete information and to keep your account secure.

4. Buying on Mocagem

• Browse, add to cart, checkout.
  
  
• Your order is accepted when we send confirmation.
  
  
• The vendor handles fulfillment (pickup, delivery, or service). Follow the vendor’s instructions (ID, timing, prep, etc.).
  
  
• Default redemption window: 90 days from purchase unless otherwise stated. After expiry the order is void.
  

5. Pricing, taxes, and fees (UPDATED)

• You’ll see price, taxes, fees, and any delivery charges before you pay.
  
  
• Mocagem always collects applicable sales taxes (e.g., HST/GST/QST) on customer payments at checkout.
  
  
• What happens to collected taxes:
  
  
  • Vendor is tax-registered: we collect tax as agent and include the tax in the vendor’s payout; the vendor is solely responsible for remitting it.
    
    
  • Vendor is not tax-registered or hasn’t provided valid proof: we collect the tax and, where required by law, Mocagem remits it. Vendor payouts won’t include these tax amounts.
• Vendors must set correct tax status/rates; if a vendor misclassifies tax or gives wrong status, we may adjust, withhold, or recover amounts from future payouts to fix it.
  
  
• Add-ons bought directly at the venue are between you and the vendor (vendor handles those taxes).
  
  
• Mocagem platform/service fees may have their own applicable taxes.

6. Payments and security

• Payments are processed by our provider (e.g., Stripe). We don’t store full card numbers.
  
  
• We and/or the processor may decline or cancel orders flagged as risky.

7. Refunds, exchanges, credits, rescheduling

Unless a listing says otherwise (or law requires more):

• Unused orders: refundable to the original payment method within 30 days of purchase. Refunds include any taxes collected on that order.
  
  
• Exchanges (same vendor): only if the listing allows or the vendor agrees via support before redemption. If the replacement costs more, you pay the difference; if less, no cash back—difference may be issued as credit if the vendor offers it. Taxes are adjusted.
  
  
• Account credit: may be offered instead of a refund in some cases. We’ll state terms when we issue it.
  
  
• Rescheduling services: follows the vendor’s policy and must happen within the redemption window. Missing a rescheduled time can be treated as a no-show.
  
  
• Used/redeemed orders: final sale.
  
  
• No-shows: no refund, exchange, credit, or reschedule.
  
  
• Expiry: after the redemption window (90 days by default) there is no refund, exchange, credit, or reschedule—order is void.
  
  
• Vendor cancel/fail to deliver: we'll refund you.
  
  
• Chargebacks: disputing a valid charge that we win may lead to account suspension.
  

8. Vendor responsibilities (summary)

Vendors must accurately list products, maintain correct tax status and rates, comply with all applicable laws, and fulfill all sales commitments. We share the necessary order details so vendors can fulfill. Vendors are responsible for remitting any taxes included in their payouts; where Mocagem remits, vendors must not also remit those amounts.

9. Acceptable use

Don't break the law, game inventory, resell at scale, spam, scrape, interfere with the service, or post defamatory/abusive/infringing content.

10. Reviews and content you post

By posting reviews/photos/comments, you give us a non-exclusive, worldwide, royalty-free license to use and share them to run and promote the platform. Keep it honest and lawful. We can remove violations.

11. Events and live experiences

You must follow event instructions and venue rules. Some events have separate terms/waivers - those apply as well. Mocagem is not a healthcare provider; all wellness/therapy services are the vendor's responsibility.

12. Service changes

We can change, pause, or end features anytime.

13. Disclaimers

The platform is provided "as is". We don't control or guarantee vendor goods/services. To the extent allowed by law, we disclaim implied warranties.

14. Limitation of liability

To the extent allowed by law, we're not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability to you is capped at the greater of CAD $100 or the amounts you paid to Mocagem in the 6 months prior to the claim. 

15. Indemnify

You'll indemnify Mocagem for claims arising from your misuse of the platform, violation of these Terms, or infringement of others' rights.

16. IP

Our site, code, logos, and content are the property of Mocagem and/or our licensors. Use the site as intended; no reverse engineering or unauthorized reproduction.

17. Privacy and communications

Our Privacy Policy explains data collection and use. By using Mocagem, you consent to transactional emails/SMS about your orders. You can opt out of marketing anytime.

18. Account closure and data retention

• To close your account, email team@mocagem.com. Self-serve deletion isn’t available.
  
  
• We may retain certain records after closure where required for legal, tax, fraud-prevention, or accounting reasons (e.g. transactional records typically retained up to 7 years in Canada). We restrict access/use of retained data to those purposes only. See our Privacy Policy for details.
